TERMS OF SERVICE
Utah Stone Surfaces LLC

These Terms of Service (“Terms”) govern all services provided by Utah Stone Surfaces LLC (“Company,” “we,” “us,” or “our”). By engaging our services, you (“Customer,” “you,” or “your”) agree to the following terms:
1. Scope of Services
Utah Stone Surfaces LLC provides concrete and stone surface services, including but not limited to installation, repair, resurfacing, sealing, and related work as outlined in the approved estimate, invoice, or contract (“Services”). Any additional work outside the original scope must be approved in writing and may result in additional charges.
2. Estimates and Pricing
All estimates are based on initial site evaluations and information provided by the Customer. Final pricing may vary due to unforeseen conditions, including but not limited to subsurface issues, material cost changes, or site accessibility challenges. We will notify you of any material changes before proceeding.
3. Payment Terms
A deposit may be required prior to scheduling work. The remaining balance is due upon completion unless otherwise agreed in writing. Late payments may incur interest at the maximum rate permitted under Utah law. Customer agrees to pay all reasonable collection costs, including attorney’s fees, if necessary.
4. Scheduling and Delays
Project timelines are estimates only and may be affected by weather, material availability, or other factors beyond our control. We are not liable for delays caused by such conditions. Customer agrees to provide reasonable access to the worksite during scheduled service dates.
5. Customer Responsibilities
Customer is responsible for:
- Providing clear access to the work area
- Removing personal property from the worksite
- Ensuring utilities (water, electricity) are available if required
- Obtaining any necessary permits unless otherwise agreed
We are not responsible for damage to items left in or near the work area.
6. Changes and Cancellations
Any requested changes to the project must be submitted in writing and may affect cost and timeline. Cancellations after work has begun will require payment for all completed work, materials purchased, and any associated costs.
7. Warranties and Limitations
We warrant that our workmanship will be performed in a professional manner consistent with industry standards. Due to the nature of concrete and stone, variations in color, texture, cracking, and wear may occur and are not considered defects.
EXCEPT AS EXPRESSLY STATED, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
8. Liability
To the fullest extent permitted by law, Utah Stone Surfaces LLC shall not be liable for indirect, incidental, or consequential damages. Our total liability for any claim arising out of our services shall not exceed the total amount paid by the Customer for the specific project.
9. Property Conditions
Customer acknowledges that concrete and stone surfaces may be affected by existing conditions such as soil movement, drainage, weather exposure, and prior installations. We are not responsible for issues arising from pre-existing conditions.
10. Indemnification
Customer agrees to indemnify and hold harmless Utah Stone Surfaces LLC from any claims, damages, or liabilities arising from Customer’s misuse of the completed work or failure to follow care instructions.
11. Governing Law
These Terms shall be governed by the laws of the State of Utah. Any disputes shall be resolved in the appropriate courts located within Utah.
12. Entire Agreement
These Terms, along with any written estimate or contract, constitute the entire agreement between the parties and supersede all prior discussions or agreements.
13. Acceptance
By approving an estimate, signing a contract, or allowing work to begin, Customer acknowledges and agrees to these Terms of Service.
14. SMS Communications
